  • Roots® Open up to Spring Contest

    OFFICIAL CONTEST RULES

    NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.

    1. SPONSOR.The Roots® Open up to Spring Contest (the “Contest”) is sponsored by Roots Corporation, 1400 Castlefield Avenue, Toronto, Ontario, M6B 4C4 (the “Sponsor”). Not sponsored, endorsed, administered by or associated with Facebook, Twitter or Instagram.

    2. ELIGIBILITY. This Contest is open to legal residents of Canada, excluding Quebec, who are age of majority in their province or territory of residence at time of entry, with the exception of employees of the Sponsor, the Fairmont Royal York, their parents, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, partners, advertising and promotional agencies, Contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of these Contest Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion.

    3. CONTEST DATES AND TIMES. The Contest begins on March 22, 2019 at 12:00 a.m. ET and ends on March 24, 2019 at 12:00 p.m. ET. (“Contest End Date”) after which time this Contest will be closed and no further entries shall be accepted. The sole determinant of time for the purpose of receipt of a valid entry will be the Sponsor’s server(s).

    4. HOW TO ENTER.You can enter this Contest as follows:

    Instagram
    You can enter this Contest on Instagram by doing all of the following:

    • Following Roots at @Roots;
    • Tagging three friends in the comments section; and
    • Posting a photograph of you in front of the Open Up to Spring Mural (located at 367 King Street West & Blue Jays Way) and tagging @Roots using the hashtags #Roots and #Contest.

    Facebook
    You can enter this Contest on Facebook by doing all of the following:

    • “Like” Roots Facebook page; and
    • Posting a photograph of you in front of the Open Up to Spring Mural (located at 367 King Street West & Blue Jays Way) and tagging @Roots using the hashtags #Roots and #Contest.

    Twitter
    You can enter this Contest on Twitter by doing all of the following:

    • Following Roots at @Roots on Twitter;
    • Retweeting the Sponsor’s Contest related tweets;
    • Posting a photograph of you in front of the Open Up to Spring Mural (located at 367 King Street West & Blue Jays Way) and tagging @Roots using the hashtags #Roots and #Contest.

    Rules For Photo Submissions:

    All entries, including photo submissions, are subject to the following rules:

    • Entrants grant the Sponsor and the Fairmont Royal York an exclusive license to use their entries for the administration of the Contest and in any advertising, marketing or publicity, without notice or compensation, as may be edited, modified or translated in the Sponsor’s sole discretion.
    • Sponsor may determine, in its sole discretion, whether or not to accept any entry and whether it will use any entry for any purpose, including in any marketing or publicity.
    • Entries cannot be any of the following, all of which shall be determined by the Sponsor in its sole discretion:
      • Sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or describe any dangerous activity.
      • Promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that are unsafe or dangerous, or any particular political agenda or message.
      • Obscene or offensive, endorse any form of hate or hate group.
      • Defame, misrepresent or contain disparaging remarks about the Sponsor, the Fairmont Royal York or their products or other people, products or companies.
      • Contain trademarks, logos or intellectual property or content owned by 3rd parties or advertise or promote any brand or product of any kind.
      • Contain copyrighted materials owned by 3rd parties.
      • Refer to the name of any person without permission from that person for you and the Sponsor to reproduce it.
      • Reproduce, whether by photograph or any other means, the image of any person without permission for you and the Sponsor to reproduce it.
      • Communicate messages inconsistent with the purpose of this Contest.

    Sponsor may require any Entrant to obtain any 3rd party consent necessary for their entry, whether to satisfy intellectual property, privacy or any other laws, before accepting an Entrant’s entry into this Contest or using an Entrant’s essay for marketing, the administration of this Contest or any other purpose, any such consent(s) which may be required by the Sponsor being be the sole obligation and expense of the Entrant.

    All entries must be complete and are subject to verification by the Sponsor, in its sole discretion. Limit one (1) entry per day per person.

    Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. No correspondence will be entered into except potential winners. Proof of transmission (screenshots or captures, etc.) does not constitute proof of entry or receipt of an entry.

    5. CONTEST PRIZES. There is 1 prize available to be won consisting of a Roots® gift card valued at $500.00 and one night stay at the Fairmont Royal York in Toronto located at 100 Front Street West, valued at $379.00 (collectively, the “Prize”) (total approximate retail value $879.00).

    All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or use or redemption of a prize. Prizes must be accepted as awarded and have no cash value. Prizes or any portion thereof cannot be combined with other discounts, promotions or special offers. The Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at time of award.

    6. ODDS OF WINNING. The odds of winning will depend on the number of eligible entries received before the Contest closes.

    7. SKILL-TESTING QUESTION. Skill-testing question required for the potential winner as a condition of winning the Prize.

    8. WINNER SELECTION AND CONFIRMATION. The potential winner of this Contest will be chosen by the Sponsor on April 5, 2019, at 1400 Castlefield Avenue, Toronto, Ontario, M6B 4C4, by random draw and will be notified on April 12, 2019. Up to three attempts will be made on January 28, 2019 to contact the potential winner. Any potential winner that cannot be contacted will forfeit their prize and another potential winner will be chosen by way of random draw. The potential winner must provide their full name, e-mail address and telephone number. The potential winner must also provide completed copies of the Sponsor’s Winner Release.

    The potential winner of this Contest will be declared by the Sponsor to be the winner if they meet all of the eligibility criteria set out in these Contest Rules. If a potential winner does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize and another potential winner will be chosen by way of random draw.

    Disputes regarding identity of entrant: If the identity of an entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the social media account associated with the entry). Each entrant may be required to provide proof that he/she is the Authorized Account Holder associated with an entry.

    9. RELEASE AND INDEMNIFICATION. The winner of this Contest must sign the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”) to: (i) confirm compliance with the Contest Rules; (ii) agree to accept prizes as awarded; (iii) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Facebook and Instagram and the Fairmont Royal York and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the Entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of an entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur in connection with any claim or demand by any third party, including any 3rd party referred to or depicted in any entry, or as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor.

    The Sponsor is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Release; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any travel related thereto and the use of the Entry by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

    10. OTHER CONDITIONS.

    Publicity and entrant information: By participating in the Contest, entrants consent to the use of their name, address, e-mail address, postal code, telephone number, social media handles, comments and image, whether on videotape, photograph or any other means, and their entries, including photo submissions, as may be edited or translated in the Sponsor’s sole discretion for the administration of this Contest or any publicity carried out by the Sponsor, Fairmont Royal York or any of their marketing partners without further notice or compensation. Entrants agree to grant the Sponsor and the Fairmont Royal York a non-exclusive license in their photograph entries to be used for any purpose, including marketing in any medium, as may be edited, modified or altered in any way by the Sponsor and to waive any moral rights in their photograph entries.

    Law: The Contest is void where prohibited by law and subject to all applicable Canadian federal, provincial, municipal and local laws. This Contest shall be governed exclusively by the laws of the province of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.

    Rule amendments: The Sponsor reserves the right, in its sole discretion to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

    Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor or the Fairmont Royal York. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor or the Fairmont Royal York is strictly prohibited.

  • Roots® Customize Award Jacket Contest

    NO PURCHASE NECESSARY. Contest begins February 7th, 2019 at 5:00 p.m. EST and ends February 11th, 2019 at 11:59 p.m. EST. There is one Roots® Customize Award Jacket prize available to be won (approximate retail value $750.00). Odds of winning depend on number of eligible entries received before Contest closes. Contest is open only to legal residents of Canada, excluding Quebec, who are at least 18 and the age of majority in their province/territory of residence at time of entry. Limit one entry per person. Skill-testing question required.

    Any entrant found to be using multiple Twitter, Instagram or Facebook accounts to enter this Contest will be ineligible to win. Only one “like” and “tweet” maximum is required to be eligible to enter this Contest. Multiple entries will not be accepted and multiple “likes” and “tweets” will not increase your chances of winning. Limit one entry per person.

    5. CONTEST PRIZES. UNCLAIMED/UNREDEEMED PRIZES WILL NOT BE AWARDED. There is one (1) Roots® Customize Award Jacket available to be won (approximate retail value $750.00).

    6. ODDS OF WINNING. Odds of winning depend on the number of eligible entries received before Contest closes.

    7. WINNER SELECTION. On February 12, 2019, a random draw will be conducted by the Sponsor or one of its representatives from among all eligible entries received during the Contest Period and one (1) potential winner chosen (the “Selected Entrant”). The Selected Entrant will be contacted on February 13, 2019 via direct message on the social platform they used to enter the contest during the week following the draw. The Selected Entrant must claim their prize no later than ten (10) days after they are initially contacted by the Sponsor. If a Selected Entrant either: (a) cannot be reached within three (3) days following the first attempt of contact; (b) incorrectly answers the Sponsor’s mathematical skill-testing question; (c) declines the Prize; (d) fails to return the Sponsor’s release form; or (e) fails to comply with any of these Contest Rules, the prize shall be forfeited and the Sponsor may, at its sole discretion, choose another Selected Entrant by way of random draw from all previously received eligible entries.

    Restrictions on Claiming Prize
    The Prize can only be claimed at the following Roots® store locations: (a) Roots Yorkdale, Bloor Street; (b) CF Pacific Centre, Halifax Shopping Center; (c) West Edmonton Mall, CF Carrefour Laval; or (d) Chinook Centre.

    8. SKILL-TESTING QUESTION. All Selected Entrants will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question.

    The Selected Entrant of this Contest must meet all of the eligibility criteria set out in these Contest Rules in order to win the Prize. If a Selected Entrant does not meet any eligibility criteria, he/she will be disqualified and will not receive the Prize. In order to receive the Prize, the Potential Winner must comply with all Contest Rules in the sole discretion of Sponsor whose decisions are final.

    9. RELEASE AND INDEMNIFICATION. All Selected Entrants agree, as a condition of entering this Contest and receiving a prize, to complete and sign the Sponsor’s winner release form to release, discharge and hold harmless the Sponsor, their departments and agencies, and their respective parents, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Facebook and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the Entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence (except for material injury caused by an intentional or gross fault if winner is a resident of Quebec), breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of an entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur in connection with any claim or demand by any third party, including any 3rd party referred to or depicted in any entry, or as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor.
