  • Roots X Shawn Mendes Awards Jacket Contest

    OFFICIAL CONTEST RULES

    NO PURCHASE NECESSARY

    1. SPONSOR. The Roots® X Shawn Mendes Awards Jacket Contest (the “Contest”) is sponsored by Roots Corporation, 1400 Castlefield Avenue, Toronto, Ontario, M6B 4C4 (the “Sponsor”). Not sponsored, endorsed, administered by or associated with Facebook or Instagram. The Contest is sponsored in association with Universal Music Canada, 2450 Victoria Park Ave, North York, ON M2J 4A2.

    2. ELIGIBILITY. This Contest is open to legal residents of Canada and the United States (excluding residents of Florida) who are at least eighteen (18) years of age and the age of majority in their province, territory or state of residence at time of entry, with the exception of employees of the Sponsor, Universal Music Canada, their respective parents, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, partners, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household of each. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion.

    3. CONTEST DATES AND TIMES. This Contest begins on December 15, 2018 at 10:00 a.m. EST and ends on January 15, 2019 at 12:00 p.m. EST (“Contest Period”) after which time the Contest will be closed and no further entries shall be accepted. The sole determinant of time for the purpose of receipt of a valid entry will be the Sponsor’s server.

    4. HOW TO ENTER. You can enter this Contest at roots.com/Shawnmendescontest for a chance to win one of 15 autographed Roots® X Shawn Mendes Award Jackets. Limit 1 entry per person per day (i.e., per 24 hour period). Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter this Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize.

    5. CONTEST PRIZES. UNCLAIMED/UNREDEEMED PRIZES WILL NOT BE AWARDED. There are 15 autographed Roots® X Shawn Mendes Award Jacket prizes available to be won (approximate retail value $589.00 CAD each).

    All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or use or redemption of a prize. Prizes must be accepted as awarded. Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at time of award.

    6. ODDS OF WINNING. Odds of winning depend on number of eligible entries received before Contest closes.

    7. WINNER SELECTION. On January 17, 2019, a random draw will be conducted by the Sponsor or one of its representatives from among all eligible entries received during the Contest Period and 15 potential winners chosen (the “Selected Entrants”). All Selected Entrants will be contacted by the telephone number or e-mail address they provided upon entry into this Contest during the week following the draw and must claim their prize as instructed no later than ten days after they are initially contacted. If a Selected Entrant cannot be reached within three (3) days following the first attempt of contact, incorrectly answers the mathematical skill-testing question (if a resident of Canada), declines the prize, fails to return the required release form or fails to comply with any of these Contest Rules, the prize shall be forfeited and the Sponsor has the right, at its sole discretion, to choose another Selected Entrant by way of random draw from all previously received eligible entries.

    All potential winners of this Contest must meet all of the eligibility criteria set out in these Contest Rules. If a potential winner does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize. In order to receive a prize, potential winners must comply with all Contest Rules in the sole discretion of Sponsor whose decisions are final.

    8. SKILL TESTING QUESTION. All Canadian Selected Entrants will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question.

    9. RELEASE AND INDEMNIFICATION. All Selected Entrants agree, as a condition of entering this Contest and receiving a prize, to complete and sign the Sponsor’s winner release form to release, discharge and hold harmless the Sponsor, Universal Music Canada, their departments and agencies, and their respective parents, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the Entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence (except for material injury caused by an intentional or gross fault if winner is a resident of Quebec), breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of an entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur in connection with any claim or demand by any third party, including any 3rd party referred to or depicted in any entry, or as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor.

    OTHER CONDITIONS

    Publicity and entrant information: By participating in this Contest, entrants consent to the use of their name, address, e-mail address, postal code, telephone number, social media handles, comments and image, whether on videotape, photograph or any other means, all as may be edited, translated or otherwise modified by the Sponsor, for the administration of this Contest or any publicity carried out by the Sponsor, without further notice or compensation, unless prohibited by law.

    Law: The Contest is void in the state of Florida and where prohibited by law and subject to all applicable Canadian and United States federal, provincial, municipal and local laws. For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “RACJ”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement. For residents of all other jurisdictions, this Contest shall be governed exclusively by the laws of the province of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.

    Rule amendments: The Sponsor reserves the right, in its sole discretion, subject to the approval of the RACJ, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

    Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited.

    Winner’s List: A list of winners of prizes valued at $25 or more may be obtained by sending a self-addressed, stamped envelope to:

    OFFICIAL CONTEST RULES

    1. ELIGIBILITY. This Contest is open to legal residents of Canada, excluding Quebec, who enter the Roots Canada store at 220 Yonge Street, Toronto, ON M5B 2L7, with the exception of employees of the Sponsors, their respective parents, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, and any other parties engaged in the development, production or distribution of the Contest materials, or those living in the same household as any of the above.

    2. HOW TO ENTER. Beginning at 3:00 p.m. Eastern Standard Time (“EST”) on December 4, 2018, entrants can enter the “SMxROOTS In Store Giveaway” (the “Contest”) by entering the Roots Canada store at 220 Yonge Street, Toronto, ON M5B 2L7 on December 4, 2018. For a no purchase entry option, entrants can submit an essay of 300 words or less on “Why I Love Shawn Mendes” online c/o umcdigital@umusic.com by 9:30 p.m. on December 4, 2018 with subject line “Why I Love Shawn Mendes”. Any use of automated devices is prohibited. Limit of one (1) entry per person. Entry is limited to the first 100 entrants.

    3. SPONSORS. The sponsors of this Contest are Roots Corporation and Universal Music Canada Inc. (collectively, the “Sponsors”). This Contest is not sponsored, endorsed, administered by or associated with Facebook or Instagram.

    4. CONTEST CLOSING DATE. To be eligible to win this Contest, entries must be received no later than 9:00 p.m. EST on December 4, 2018 (the “Contest Closing Date”).

    5. PRIZES. There are twenty-one (26) random prize packages (the “Prize Package”) available to be won from the list of prizes below. Each winner will receive one random (1) Prize Pack only:

    • One (1) signed Award Jacket;
    • Ten (10) VIP packages;
    • Five (5) Sweatshirts;
    • Five (5) Sweatpants;
    • Five (5) T-Shirts.

    The prizes will be randomly selected by the Sponsors

    Approximate retail value of each Prize Package ranges from $36.00 to $720.00 depending on the specific Prize Package. The Prize Packages as described are subject to availability, may not be exchanged for cash, are non-transferable, non-refundable, may not be sold, and must be accepted as awarded, without substitutions. At their election, and in the event a Prize Package, or any portion thereof, cannot be awarded as described in these Official Rules, the Sponsors reserve the right to substitute a prize of equivalent or greater retail value.

    6. WINNER SELECTION. Contest judges at the store will make random draws for the Prize Packages during the operating hours of December 4, 2018 from all eligible entries. The selected entrants will be notified by the judges in store on December 4, 2018. If a winner leaves the store and fails to obtain their Prize Package, the Prize Package will be awarded to another entrant. Prizes will decrease as awarded.

    7. ODDS OF WINNING. Odds of winning will depend upon the total number of eligible entries received before Contest closes. All decisions of the Sponsors’ judges are final in all matters relating to this Contest.

    8. RELEASE AND INDEMNIFICATION. All potential winners agree, as a condition of entering and participating in this Contest, to complete and sign the Sponsors’ winner release form to release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Facebook and Instagram and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the Entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence (except for material injury caused by an intentional or gross fault if winner is a resident of Quebec), breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of an entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur in connection with any claim or demand by any third party, including any 3rd party referred to or depicted in any entry, or as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor.

    By entering and participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules and Regulations, including eligibility requirements. Entrants release and hold harmless the Sponsors, Facebook and Instagram,, and their respective parents, related and affiliated companies, subsidiaries, members, dealers, advertisers, franchisees, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, artists, advisors, assignees, and all others associated with the development and execution of the Contest, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize Package awarded.

    The Sponsors are not responsible for incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules and Regulations. No responsibility will be taken by the Sponsors for lost, delayed, mutilated or misdirected entries.

    1. SPONSOR. The Roots Fall Event Contest (the “Contest”) is sponsored by Roots Corporation, 1400 Castlefield Avenue, Toronto, Ontario, M6B 4C4 (the “Sponsor”). Not sponsored, endorsed, administered by or associated with Facebook or Instagram.

    2. ELIGIBILITY. The Contest is open to legal residents of Canada and the United States who are at least eighteen (18) years of age and the age of majority in their province, territory or state of residence at time of entry, with the exception of employees of the Sponsor, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, partners, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules.     3. CONTEST DATES AND TIMES. Bonus cards are available in participating Roots locations in Canada and in Boston, Washington, D.C., New York, Utah and Michigan in the United States beginning on October 11, 2018 (October 4, 2018 in the United States) and ending on October 14, 2018 (October 9, 2018 in the United States) or while supplies last, whichever occurs first (“Contest Period”).

    4. HOW IT WORKS. To get a bonus card, visit a participating Roots location in Canada or in Boston, Washington DC, New York, Utah or Michigan in the United States and make a qualifying purchase. Bonus cards are available in-store only. After making a purchase, customers will receive a bonus card that can be scratched in-store to determine whether a prize/discount has been won. Limit 1 bonus card per customer per visit. Multiple purchases in a single visit will not entitle customers to obtain more than one (1) bonus card for this Contest. Bonus cards will not be provided with gift card purchases, custom orders, purchases made using a discount awarded in this Contest, select specialty items as marked or for previously purchased merchandise before the Contest start date.

    No Purchase Entry Alternative: As an alternative to making an in-store purchase, entrants may hand write an essay of up to 250 words on the topic of why Fall is their favorite season. Upon receipt, a representative of the Sponsor will play the game for you. Only winners will be notified. Limit one (1) request per day. Limit one (1) request per outer stamped mailing envelope. Sponsor not responsible for lost, late, misdirected, illegible, incomplete, damaged, postage due or mutilated mail.

    Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize/discount.

    If due to printing, production or other errors, more prizes/discounts are claimed than intended, the intended prize/discount will be awarded in a random drawing from all those submitting purportedly valid claims. No more than the number of prizes/discounts set forth in these Official Rules will be awarded. Bonus cards not legitimately obtained and/or used in accordance with these Official Rules are void. ALL POTENTIAL WINNING OFFICIAL BONUS CARDS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A PERSON IS NOT A WINNER OF ANY PRIZE/DISCOUNT, EVEN IF HIS/HER BONUS CARD SHOULD SO INDICATE, UNLESS AND UNTIL SAID PERSON’S ELIGIBILITY AND THE BONUS CARD HAS BEEN VERIFIED AND SAID PERSON HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

    5. CONTEST PRIZES/DISCOUNTS. UNCLAIMED/UNREDEEMED PRIZES/DISCOUNTS WILL NOT BE AWARDED. There are 22,945 prizes/discounts available to be won: (i) 6,790 Hamilton Toques (approximate retail value (ARV) 22.00 CAD ea. ($16.72 USD ea.)); (ii) 8,050 Cabin Socks (ARV $18.50 CAD ea. ($14.00 USD ea.)); (iii) 3,450 Salt & Pepper Kangas (ARV $82.00 CAD ea. ($62.33 USD ea.)); (iv) 55 Small Banff Bags (ARV $468.00 CAD ea. ($355.74 USD ea.)); and (v) 4,600 45% discount on a future Roots purchase. The number of prizes/discounts will decrease as awarded. Contest prizes will be instantly awarded in-store, unless a potential winner has participated via the mail-in method of entry, in which case, the prize/discount will be shipped to the winner.. If a particular prize is not available in-store at the time when the prize is won, the prize, or an alternative prize of equal or greater value in Sponsor’s discretion, will be offered in the form of a gift card. Limit one (1) prize/discount per person. Total approximate value of Contest prizes will be CAD $733,297.00.

    Prizes and discounts have no cash value and cannot be combined with any other coupons, discounts, offers or promotions. Discount prizes will be calculated on merchandise totals only before applicable taxes and shipping. Discounts must be used at time of purchase for winners making a purchase. For no purchase winners, discounts must be redeemed by December 31, 2019.

    All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or use or redemption of a prize.     7. WINNER SELECTION. Persons receiving a bonus card in store with purchase must have their bonus card scanned in-store, prior to the end of the respective Contest Period. Skill-testing question required for Canadian residents prior to awarding of any prize.

    Publicity and entrant information: By participating in the Contest, entrants consent to the use of their name, address, e-mail address, postal code, telephone number, social media handles, comments and image, whether on videotape, photograph or any other means for the administration of this Contest or any publicity carried out by the Sponsor, without further notice or compensation, unless prohibited by law.

    Law: The Contest is void where prohibited by law and subject to all applicable Canadian and American federal, provincial, municipal and local laws. For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “RACJ”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement. For residents of all other jurisdictions, this Contest shall be governed exclusively by the laws of the province of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.

    Rule amendments: The Sponsor reserves the right, in its sole discretion, subject to the approval of the RACJ, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

    Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited.

    1. COMMANDITAIRE. Le concours « Les incontournables de l’automne Roots » (le « concours ») est commandité par Roots Corporation, 1400, avenue Castlefield, Toronto (Ontario) M6B 4C4 (le « commanditaire »). Ce concours n’est pas associé à/commandité, approuvé, administré par Facebook ou Instagram.

    2. ADMISSIBILITÉ. Le concours est ouvert aux résidents légaux du Canada et des États-Unis âgés d’au moins dix-huit (18) ans, ayant atteint l’âge de la majorité dans leur province, territoire ou état de résidence au moment de la participation, à l’exception des employés du commanditaire, de ses sociétés-mères, affiliées, filiales, départements ou agences, franchisés, fournisseurs, partenaires, agences de publicité et de promotion, administrateurs du concours et autres parties qui prend part au développement, à la production ou la distribution du matériel du concours, et ceux qui vivent sous le même toit. En participant à ce concours, les participants reconnaissent qu’ils acceptent d’être liés par le présent règlement. Les participants qui ne se conforment pas au Règlement du concours peuvent être disqualifiés par le commanditaire, à sa seule discrétion.

    3. DATES ET HEURES DU CONCOURS. Les cartes-primes sont offertes dans les magasins Roots participants du Canada ainsi qu’à Boston, à Washington (DC), et des états de New York, de l’Utah et du Michigan (États-Unis) à compter du 11 octobre 2018 (4 octobre 2018 aux États-Unis), jusqu’au 14 octobre 2018 (le 9 octobre 2018 aux États-Unis), ou jusqu’à épuisement des stocks, selon la première éventualité (« période du concours »).

    4. DÉMARCHE. Pour obtenir une carte-prime, les participants doivent visiter un magasin Roots participant au Canada ou à Boston, à Washington (DC), et des états de New York, de l’Utah et du Michigan (États-Unis) et effectuez un achat admissible. Les cartes-primes sont offertes en magasin seulement. Après avoir effectué un achat, les consommateurs recevront une carte-prime qui peut être grattée en magasin afin de déterminer si un prix ou un rabais a été gagné. Limite d’une (1) carte-prime par client et par visite. Les achats multiples effectués en une seule visite ne permettent pas aux consommateurs d’obtenir plus d’une (1) carte-prime dans le cadre de ce concours. Les cartes-primes ne seront pas rabais avec les achats de cartes-cadeaux, d’articles personnalisés, d’achats effectués sur lesquels s’applique le rabais octroyé dans le cadre de ce concours, d’articles spécialisés tels que marqués, ou de la marchandise achetée au préalable, avant le début du concours.

    Participation sans achat : Au lieu de faire un achat en magasin, les participants peuvent rédiger un texte de 250 mots maximum portant sur les raisons pour lesquelles l’automne est leur saison préférée.     Si, pour des raisons d’impressions, de production ou d’autres erreurs, davantage de prix/rabais sont réclamés, le prix/le rabais prévu sera attribué par tirage au sort parmi tous ceux qui soumettront une réclamation présumée valide. Aucun prix ou rabais supplémentaire ne sera accordé dans le cadre de ce concours, tel qu’indiqué par ce Règlement.     5. PRIX/RABAIS DU CONCOURS. LES PRIX/RABAIS NON RÉCLAMÉS NE SERONT PAS ATTRIBUÉS. Il y a 22 945 prix/bons rabais à gagner : (i) 6 790 tuques Hamilton (valeur approximative au détail 22,00 $ [16,72 $ US]) ; (ii) 8 050 paires de chaussettes style cabane (valeur approximative au détail 18,50 $ [14 $ US]) ; (iii) 3 450 chandails à capuchon Salt & Pepper (valeur approximative au détail 82 $ [62,33 $ US]) ; (iv) 55 petits sacs Banff (valeur approximative au détail 468 $ [355,74 $ US]) ; et v) 4 600 bons rabais de 45 %. Le nombre de prix/rabais diminuera au fur et à mesure que les prix seront attribués. Les prix du concours seront attribués instantanément en magasin, à moins qu’un gagnant potentiel n’ait participé par la poste ; dans ce cas, le prix/rabais sera envoyé par la poste. Si un prix particulier n’est pas disponible en magasin au moment où le prix est gagné, le prix sera remis sous forme d’une carte cadeau. Limite d’un (1) prix/rabais par personne. La valeur totale approximative des prix du concours sera de 733 297 $ CA.

    Les prix et les rabais n’ont aucune valeur monétaire et ne peuvent être combinés à une autre remise, offre ou promotion. Les rabais seront calculés sur le montant total des articles avant les taxes et les frais d’expédition applicables. Tout gagnant en magasin doit utiliser son rabais au moment de l’achat. Pour les gagnants sans achat, les rabais doivent être utilisés avant le 31 décembre 2019.

    Il incombe à tous les gagnants d’assumer l’entière responsabilité des blessures ou des dommages causés ou prétendument causés par leur participation à ce concours, ou en utilisant ou obtenant un prix. Les prix doivent être acceptés tels que décernés. Les prix, en tout ou en partie, ne peuvent être combinés avec d’autres rabais, promotions ou offres spéciales. Si un prix annoncé n’est pas disponible au moment de l’attribution, le commanditaire se réserve le droit de le remplacer par un autre prix de valeur égale ou supérieure.

    6. CHANCES DE GAGNER. Les chances de gagner : tuque Hamilton : 1 sur 17 ; paire de chaussettes style cabane : 1 sur 14 ; chandail à capuchon Salt & Pepper : 1 sur 33 ; petit sac Banff : 1 sur 2 000 ; bon rabais de 45 % : 1 sur 25.

    7. SÉLECTION DU GAGNANT. Les personnes qui reçoivent une carte-prime en magasin avec leur achat doivent faire scanner leur carte-prime en magasin, avant la fin de la période du concours. Les résidents canadiens doivent répondre à une question réglementaire avant de recevoir leur prix.

    Tous les gagnants potentiels de ce concours doivent répondre à tous les critères d’admissibilité énoncés dans le présent Règlement. Si un gagnant potentiel ne répond pas aux critères d’admissibilité, il sera disqualifié et ne recevra pas de prix.     8. DÉCHARGES ET CLAUSES D’INDEMNISATION. Tous les gagnants doivent accepter d’exonérer, de décharger et de tenir à couvert le commanditaire, ses départements, ses organismes, ses sociétés mères, apparentées et affiliées, ses filiales, ses franchisés, ses agences de publicité et de promotion, ses partenaires marketing, Facebook et Instagram, et tous leurs directeurs, dirigeants, employés, actionnaires, successeurs, commanditaires, partenaires, licenciés, filiales, agents, artistes, conseillers, cessionnaires et autres associés à la gestion, au développement et à l’exécution du concours (les « parties exonérées ») contre toute poursuite ou tout motif, réclamation ou demande, perte ou préjudice, utilisation ou mauvaise utilisation d’un prix ou tout voyage s’y rapportant, et utilisation de la participation par le commanditaire, la poursuite, la dette, la convention, le contrat, y compris les frais et honoraires juridiques, de quelque nature que ce soit, y compris, sans toutefois s’y limiter, les réclamations fondées sur la négligence (sauf la responsabilité pour dommages causés par une faute intentionnelle ou une faute lourde si le gagnant est un résident du Québec), rupture de contrat et violation fondamentale, manquement d’un tiers entrepreneur ou fournisseur en relation avec tout aspect du concours pour exécuter ou livrer des biens ou des services, événement imprévisible majeure ou tout autre événement indépendant de la volonté des parties libérées, de toute insatisfaction de la part du gagnant concernant tout aspect du concours ou de tout prix, responsabilité pour blessure physique, décès ou dommage matériel que les participants, invités, héritiers, successeurs ou les ayants droit ont ou pourraient avoir suite à la participation d’un participant au concours ou en relation avec l’acceptation par le participant du prix tel qu’il est attribué ; et (iv) indemniser les parties libérées contre les pertes, dommages ou dépenses, y compris les frais juridiques, que l’une des parties exonérées pourrait subir ou engager en relation avec toute réclamation ou demande par un tiers, y compris toute tierce partie mentionnée ou représentée dans toute inscription, ou à la suite d’une non-conformité d’un participant aux règles du concours ou à la participation au concours ou à l’acceptation par un participant d’un prix et à l’utilisation de l’inscription par commanditaire.

    9. AUTRES CONDITIONS.

    Information sur la publicité et les participants : En participant au concours, les participants consentent à ce que leur nom, adresse, adresse électronique, code postal, numéro de téléphone, commentaires et images sur les médias sociaux soient, entre autres, enregistrés sur vidéo et photographier pour l’administration de ce concours, ou toute publicité effectuée par le commanditaire, sans avis ou compensation, sauf si la loi l’interdit.

    Loi : Le concours est nul là où la loi l’interdit et sous réserve de toutes les lois fédérales, provinciales, municipales et locales applicables, canadiennes et américaines. Pour les résidents du Québec, tout litige concernant le déroulement ou l’organisation d’un concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux (la « RACJ ») pour une décision. Un différend quant à l’attribution d’un prix peut être soumis au conseil uniquement pour tenter de le régler. Pour les résidents de toutes les autres juridictions, ce concours sera régi exclusivement par les lois de la province de l’Ontario, y compris les problèmes et questions concernant l’élaboration, la validité, l’interprétation et l’applicabilité du Règlement du concours, droits et obligations entre les participants et le commanditaire, et des dispositions procédurales, sans égard aux règles ou dispositions en matière de compétence législative ou de conflit de lois.     NO PURCHASE NECESSARY

    1. ELIGIBILITY. This Contest is open to legal residents of North America, excluding Quebec and Louisiana, who are age of majority at time of entry such that they can participate in this Contest according to the terms of this Contest, with the exception of employees of the Sponsors, their parents, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household. By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules.     3. CONTEST CLOSING DATE. To be eligible to win the Contest, entries must be received no later than 11:59 p.m. ET on October 11th, 2018 (the “Contest Closing Date”).

    4. GRAND PRIZE. There will be one (1) Student Pack Tribe (the “Grand Prize”) available to be won (approximate retail value of the Grand Prize is $328.00 CAD). The Grand Prize as described are subject to availability, may not be exchanged for cash, are non-transferable, non-refundable, may not be sold, and must be accepted “as awarded”, by the Sponsors. The selected entrant for the Grand Prize (the “Winner”) shall be responsible for any costs and expenses associated with the Grand Prize and not specifically referred to in these Official Rules and all applicable taxes in respect of any such additional expenses are the sole responsibility of the Sweepstakes winner.     By entering the Contest, entrants consent to the use of their Twitter handle in any publicity carried out by any one or all of the Sponsors with respect to this Contest, without further notice or compensation.

    By entering this Contest electronically and voluntarily providing your personal information, entrants consent and agree to the Sponsors’ collection and use of the entrant’s information for the administration of this Contest and agree to Sponsors’ use of entrant information for the purpose of contacting entrant in relation to this Contest. For the avoidance of doubt, entrants are providing information to the Sponsors, not Twitter.

    By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules, including eligibility requirements.     The Sponsors agree that they shall collect, assemble, obtain, hold and use electronic addresses and related information for the purposes identified in this Agreement and in full compliance with Canada’s Anti-Spam Legislation, including all regulations enacted thereunder from time to time (“CASL”). Sponsors are prohibited from sharing and will not share, publish or sell any electronic addresses and/or e-mail lists containing electronic addresses provided by or collected or obtained by Sponsors for the purpose of this Contest.

    Sponsors agree to maintain records of CASL compliance, including but not limited to: (i) sufficient and reliable evidence of the collection of, or other basis for, consent; (ii) the withdrawal of consent; (iii) the inclusion and proper functioning of unsubscribe mechanisms; and (iv) the inclusion of any required disclosures in communications, as applicable. Sponsors further, at its expense and upon thirty (30) days prior written notice, appoint its own personnel or an independent third party to inspect, audit and verify that Sponsors use of electronic addresses and related information complies with the terms of this Contest and CASL;

    The Sponsors reserve the right, in their sole discretion to cancel or suspend this Contest without notice should any cause beyond the reasonable control of the Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way.

    By participating in this Contest, entrants grant the Sponsors and any of their marketing or other partners or agents an exclusive license to use any entry, social media post or any other content generated by entrants in order to enter and participate in this Contest, as may be edited or modified in any way by the Sponsors in their sole discretion, without notice and without any compensation to entrants for any marketing or promotional purposes in any media whatsoever.
